These Terms & Conditions ("Terms") govern your access to and use of the website momsheritagespices.com (the "Website") operated by Mom's Heritage Spices ("we", "us", "our"), and your purchase of any products through it. By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

Where an account is used, you are responsible for maintaining the confidentiality of your login details and for all activity under your account.

4. Product Information & Availability

7. Order Placement & Acceptance

Placing an order through the Website constitutes an offer by you to purchase the selected products. An order is not accepted until we confirm it (via order confirmation email/notification). We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability, in which case any payment already made will be refunded.

8. Order Cancellation

You may request cancellation of an order before it has been dispatched, subject to our Refund & Cancellation Policy. Once an order has been dispatched, it cannot be cancelled, though our Refund & Cancellation Policy explains options available for damaged, incorrect, or defective items upon delivery.

9. Payment Terms & Cash on Delivery

We accept payment via the methods displayed at checkout, which may include Cash on Delivery (COD), UPI, credit card, debit card, and net banking, as available. Where COD is enabled, payment is collected in cash at the time of delivery. Online payments are processed securely through our third-party payment gateway; we do not store your complete card or banking credentials.

10. Product Images

Product images on the Website are for illustrative purposes. While we aim for images to closely represent the actual product, minor variations in packaging, colour, or appearance may occur due to photography, screen display settings, or product batch variation.

We shall not be held responsible for any delay or failure to perform our obligations resulting from causes beyond our reasonable control, including natural disasters, strikes, transportation disruptions, government action, or other events of force majeure.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to the dispute resolution provisions below, the courts at Gautam Buddh Nagar, Uttar Pradesh, India shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Website.

18. Dispute Resolution

In the event of any dispute, you agree to first contact us at the details in Section 20 so we can attempt to resolve the matter amicably. This does not limit your rights under the Consumer Protection Act, 2019, including your right to approach the appropriate Consumer Disputes Redressal Commission.
